  • With H1B Auth, but No Visa

    I came to the US as a student on F1. After I graduated, the company changed my status to H1B. This was done last year, Oct 2008. I have not gone back home since then. Therefore, I just have the change of status and the expired F1 visa.

    Starting January 2010, my employer will apply for my GC. Will this impose any potential problem along the way? That I do not have a visa that corresponds to my current status here in the US? I, however, do have a legal/legit status here.

    No problem at all. You only need a visa when you leave the US and want to come back.
