  • I answered 'No' for being arrested, I-485.

    I was arrested for shoplifting case since 2007. I answered no for the question “have you ever arrested” I don’t have any problem except the shoplifting. I went to a court and the case was dismissed I paid $250 if I want to dismiss the case. Does the immigration know about it? Do they ask about it? What should I do if I will be asked about it?

    Look!

    Never hide anything from USCIS during AOS process. All documents must be filled in to the nearest 100% truthfulness. Because your are not done even after getting your Green card. You still have to go through naturalization process. So a willful lie will be caught one way or the other. You have two choices. Either hire an attorney and have him take care of it or you can call USCIS and explain the situation and most probably you will have to send in a new package. We all make mistakes so the best way to handle is come out clean . Shoplifting does constitute CMT and not disclosing it can be a basis for denial. Under certain situations you can file a waiver on form I-601, with a fee.
