My husband and I just recently found out that he needed to change his marital status from his employer (I know we are kinda of stupid...) after he got married with me in August. Now, I need to apply for the AOS, and need his past 6 months' pay stubs. His pay stubs show he's still single. What should we do now? Shall he go to change his marital status now, or it doesn't matter as long as we file 2009 tax return together? He's changing to another job in January. Don't know what to do now. Any advice from anyone will be greatly appreciated.

These are trivialities, nobody will ask you for your paystubs, if AOS, is filed under marriage categories, there are more strigent things that will be required of you , of which pay stubs is the minutest of them. You may file jointly to show that you are joined by the hip or you may file separately as married filing separately, but it would be better if you file jointly, provided that you are legally authorized to work and earn a living. Be careful, IRS and USCIS ARE MORE UBIQUITOES AND DANGEROUS THAN THE POLICE AND FBI COMBINED TOGETHER. You should always go to these 2 with a clean hand if you want equity.
