I'm German, used to live on a mexican FM3 visa near Tijuana, Mexico. Crossed the land-border MX-US by Visa Waiver. Answered NO on the question; have you ever ..denied an US Visa. Have 2 visa denials in 2007 and 2008.
Not reading all questions carefully, always in a hurry... Since april 2009 SEVEN I-94W, since I live in Mexico. Never a problem..
But: Now I live in San Diego, married to an USC, applying for GC in February. Question 10 on I-485: did I WILFULLY commit an immigration fraud ?? If I'll answer question 10 by YES and explain this on a separate sheet, will this do it, or do I need IN ANY CASE to apply for a waiver (I-601), extreme hardship for my wife...
Opininons of immigration lawyers are very different, some say YES, have to apply for I-601, others saying, the well written explanation will do it, since I am retired and even don't want to work here, just living happily together with my wife. It also depends on the review of the adjudicating officer.
Some advise ??
