i-130/i-485 for sister.

My sister from india, was on a l1 visa and then was married . she tacked on to my brother in law's h1b - employment based gc application and obtained an ead card through that application..

My sister unfortunately is going through issues with her marriage and considering divorce and evaluating impact to her gc due to this.

her options are

1.) apply for a h1b through her job which should be easy now considering all the h1b applications are not fulfilled... and then apply for an employment based immigration ..

2.) i (her) brother is a citizen of usa . question is can i apply for her i-130/i-485 so that she can remain in the US ?

1. H1B quote for financial year 2010 is over.
2. That is not possible. It would be around 10 to 12 years before the priority date would be current and she be able to file I-485.
