    Hello a friend of mine filed I-130 package and I-485, I-864 for me!

    Im a U.S. Citizen and got married in Honduras about a year and a half ago now im trying to bring my wife here to U.S.!

    I mailed all papers last week on 1/19/10!

    Today(1/29/10) I got everything back with the following rejection notices!

    heres the info that each say!

    NOTICE #1


    I-130 - Petition for Alien Relative

    The application/petition you filed along with any fee you submitted is being returned to you for the following reason(s):

    The entire application package you filed along with any fees you submitted is being returned to you for the following reason(s)

    The principal application could not be accepted for the reason(s) specified on the related Notice of Action(Form I-797). Therefore the processing of all riding applications cannot continue.


    NOTICE #2

    I-485- Application to Register Permanent Residence or Adjust Status

    On the attached application you listed a foreign address. This application may not be filed by an applicant who resides outside the U.S. Therefore, it cannot be processed and is rejected.

    If you reside in the U.S., please resubmit the application listing your U.S. address, with proper fee and supporting documentation.


    now my questions are:

    I really dont get notice #1 is that just saying to check notice #2 or something can someone explain?

    Now for Notice #2 do I just put my current U.S. address and not use my wife current address outside of the U.S. even though shes not here yet?


    Please respond with any tips I would like to send back the app. asap!

    You cant file for adjustment of status if she is not in the US

      L2 to H4

      I have been working on L2 visa. My spouse's H1B and consequently my H4, approved effective this January 1st, and intimation received by us on January 4th. My spouse joined new job on Jan.11 (as H1B) and I quit the job on Jan.22nd. Are the time lines ok?

        hELLO

        I understand what the problem is. the person not in the United states, so you cannot file adjustment of status for them. Because of that your petition cannot be accepted. if your wide could come to the US, then the adjustment could be processed. if not, you can put in the petition for her, and she can file when it is approved in her country. however, If you can, bring her to the US, and since you have been married for a year and half, you only need a few more month and she can be eligible for a straight permanent residency rather than the conditional one she might get if it was accepted before... hope this helps.... I have done so much research to understand the USCIS process, so that I don't make mistake on my own application, yet I still find I get confused sometimes, so this site is really good for sharing....good luck
