gotta live together
USCIS officers seem to doubt the bona fide marriage if a husband and a wife are not living together for no matter what reasons. I am sure there are many USC couples that live separately, for children situations, school situations or work situations etc. and happily married. But in terms of a USC married to a foreign spouse, these situations would not seem to count. You have to live with your spouse together. I hope you and your spouse can get along in order to do so, though. You have to have bona fide marriage.

Well honestly, your case seems to me to be fraudulent. Yes you can apply when ever you want, but USCIS scrutinizes all cases and your case seemed fraudulent to them. You have not provided more information as to who is the father of the child? and why you have not been living with your present husand when you filed AOS?, does your husband (present) have any previous marriage? etc. You say that you filed after 2 yrs being married to him, but then why didnt you stay together? Now after 3 yrs you want to divorce him, when you marry your new hubby, there will be a question of intent here too. Well all depends on the officer, i just wish you luck.
