Need advice in 245i

Can 245i form be used for AOS, if the employers for the primary are different

Hi,

You can take advantage of 245i even if the initial petitioner for Labor Certification is different. I guess you might need another LC from new employer as LC is only for one person. However , the first LC MUST be in your name (filed before the April 2001 deadline) to be eligible. LCs from that period can not be substituted to qualify.
