  • Query regarding adjusting status in the USA

    Dear Immi Help,

Can you help with the following enquiry, my wife - a US citizen and myself - a UK citizen married in 2006 on a K-1 visa in the USA. Of course we got married within the 90 day window a K-1 Visa requires, but soon after we decided to move to London as we were offered career opportunities that we simply couldn't turn down - so, I didn't actually adjust status - we got married within the 90 day K-1 visa window then about 5 days beyond the 90 day cut off point we moved to the UK (Homeland Security said this 5 day overstay wasn't a problem because it was so small - the fact we did get married within the 90 day window was enough for them to know we were genuine).

Anyhow, we are now in a position almost four years later that we are considering a move back to the USA; however, what is my situation now in the light of what I have just explained? Do I need to contact the USA embassy in the UK and re-file there? Or can I simply go to the USA and just pick up where I left off and file to adjust status when I enter the USA?

Any help with this matter would be most gratefully received.
