  • Lost I-94

Hi, am about to start filing, entered on student visa and out of status but married to USC...my passport was stolen and found/returned to my home embassy with no I-94 intact....there is a handwritten number on my visa...is this the alien #? if so, will i need to apply for a copy of I-94 before I even start filing? Also, can neone who may have filed while out of status share their experience? Thank you in advance!! ~Nervous in California.

Your case seems complicated. Best advice, hire a good attorney. I know attorneys are expensive, but AOS is an important part of your life, it can either make it or break it. So decide wisely. You will have to apply for I-94 replacement, first. But there is a catch, as you are out of status (since when?) and no AOS process has strated yet, so by applying for I-94 replacement, you might very well be exposing yourself to more trouble. Consult with an attorney.
