  • USCIS says we didn

    Hi all-

I am very distraught. It's even hard for me to type right now because my hands are shaking. I am a USC petitioning for my foreign spouse's AOS and Green Card. Our Priority Date was back in July of 2017. We finally got a text message (I even made a post here with my excitement) on January 31st saying our case was scheduled for an interview.

Weeks passed and we received no notice. I would check the mail every day with such anticipation. I called twice in February trying to understand why we hadn't mailed the letter. The second time I called in February, the person on the phone said it was still within the normal processing time and that there was nothing she could do until March 6, when she could submit an inquiry.

On March 6th, I called USCIS and submitted the formal inquiry. Today, I received a letter in the mail saying they sent my interview notice to my "address on file" and that their records indicate that I did not appear for my interview. They could not provide me a copy of the letter.

I called USCIS immediately and the representative was very apologetic. I said I was very distraught and he told me he felt distraught for me. Everything I said to him about me calling to inquire twice and then making a formal inquiry was corroborated in the notes they have for my file. He transferred me to an Immigration Officer but they scheduled a call back between now and 243 minutes from now. It's now 8 pm EST and their offices are closed so I am not holding my hopes up for a call back today.

What I want to know is, if they said to me in today's letter that they sent the notice on January 31st, if I called TWICE in February, why could no agent tell me that their records showed that my receipt was mailed?! They must have had it in a record somewhere, because today's notice says "our records indicate we mailed your letter on January 31st."

I am really upset and frustrated. It's been nearly 3 years. I want this to be over. Someone please offer me words of encouragement. When I opened up my mailbox I was so excited to get a letter from USCIS. I thought it was finally our interview notice. To get the letter I got from them today just crushed me.

    Thank you for reading.

I'm sorry to hear about this devastating situation. You've been waiting for over a year and a half for your interview, and missed it through no fault of your own. It sounds like you did everything right, and USCIS dropped the ball on this one. Therefore you should have no need to despair- just be patient while this situation is resolved. I hope they can reschedule a new interview for you soon. At least the USCIS officer you spoke to was sympathetic to your situation.

Here's what happened to me. When my husband moved in with me, I submitted a change of address 8 months ago and received a confirmation letter of the address change. On March 6th I got an online update that our green card interview was finally scheduled- and the interview notice was mailed. Wasting no time, I called UCSIC and asked to speak to a Tier 2 Office to find out when our appointment would be. It was scheduled for April 12th. 2 weeks had passed and I never received the interview letter. I knew there was a problem because a standard domestic letter usually takes 2 or 3 days to arrive. So I called USCIS and asked to speak to a Tier 2 officer again. I told them that it's been 2 weeks since my interview appointment letter was mailed, and I never received it. I asked to confirm what address it was sent to. They said that there was "a glitch in their system" and the appointment letter was mistakenly sent to the old address that was on my original application. She said they would send another letter to my current address, so I'm hoping that it will arrive any day now. She said if it doesn't in 5 days before the appointment- call them back and they will fax me the appointment notice. I don't have a fax machine, so I would need to arrange this at an Office Depot or Staples.

This shows that the UCSIC makes mistakes in regards to sending out their appointment notices. Luckily I was proactive about calling UCSIC to find out the appointment date, and calling again to find out what address it was sent to. If I had simply kept waiting for the interview letter to arrive, I would have never received it and would be a no-show to my interview like you. I really hope that UCSIC will take an extra step, and reschedule you a new appointment very soon. Keep calling them to follow up. Ask to speak to a Tier 2 officer, and escalate your claim to a higher officer until it is resolved. I wish you the best of luck, and please let us know what happens.

Thank you so much for your kind words. An Immigration Officer actually did return my call last night and confirmed me that they did make a mistake and sent the letter to my old address, I filed a change of address back in June of 2018 and received a notice confirming the address change, but they still sent it to my old address. The IO said they would work to quickly reschedule the interview and assured me the notice would be sent to the correct address.

I am just upset with myself overall because when I called both times in February I should have asked to speak with an Immigration Officer instead of dealing with the contractors. The contractors just parrot information dictated on the website and can't tell you anything else. I am staying strong but I am exasperated and just want this to be over.

Don't be hard on yourself, this things can happen and normally people can't get good results with lack of information. You didn't know that L2 officers can give you the interview date or have more information. Good luck.
