  • USCIS says we didn't show for interview, but we never got notice!!!

    Hi all-

I am very distraught. It's even hard for me to type right now because my hands are shaking. I am a USC petitioning for my foreign spouse's AOS and Green Card. Our Priority Date was back in July of 2017. We finally got a text message (I even made a post here with my excitement) on January 31st saying our case was scheduled for an interview.

Weeks passed and we received no notice. I would check the mail every day with such anticipation. I called twice in February trying to understand why we hadn't mailed the letter. The second time I called in February, the person on the phone said it was still within the normal processing time and that there was nothing she could do until March 6, when she could submit an inquiry.

On March 6th, I called USCIS and submitted the formal inquiry. Today, I received a letter in the mail saying they sent my interview notice to my "address on file" and that their records indicate that I did not appear for my interview. They could not provide me a copy of the letter.

I called USCIS immediately and the representative was very apologetic. I said I was very distraught and he told me he felt distraught for me. Everything I said to him about me calling to inquire twice and then making a formal inquiry was corroborated in the notes they have for my file. He transferred me to an Immigration Officer but they scheduled a call back between now and 243 minutes from now. It's now 8 pm EST and their offices are closed so I am not holding my hopes up for a call back today.

What I want to know is, if they said to me in today's letter that they sent the notice on January 31st, if I called TWICE in February, why could no agent tell me that their records showed that my receipt was mailed?! They must have had it in a record somewhere, because today's notice says "our records indicate we mailed your letter on January 31st."

I am really upset and frustrated. It's been nearly 3 years. I want this to be over. Someone please offer me words of encouragement. When I opened up my mailbox I was so excited to get a letter from USCIS. I thought it was finally our interview notice. To get the letter I got from them today just crushed me.

    Thank you for reading.

Do not worry, they can reschedule the interview for you. It's obviously not your mistake and you had done what you can.
    Good luck.

Thank you! I really hope that when it is rescheduled will be some time in the near future (hopefully not six months from now)
