  • Laid off before 180 Days of filing AOS- Please help!

    Hi,

    I was laid off 15 days before 180 days of filing AOS. I am hoping to get my company extend my tenure for some more days to fulfill 180 days. My finger printing is done and I have my EAD.

    1. Does the 180 days start from my 1485 notice date or my finger priting date?

    2. After the appropriate 180 days waiting period, can I use my EAD to get into a new job (with the same job description as my old job) or should I be getting a new H1. In effect how do I make sure that my AOS application does not get affected?

    3. My I485 notice date is 4\17\01 (EB2) and the finger printing was done on Sep 1st. Has anyone closer to this date got their AOS approved?

      Can one use FMLA to complete 180 days in case employer wants to lay off before 180 days of filing AOS?
