  • Pending I-485 questions

    Hello everyone,

First of all I am sorry for the long post in advance.

I am a new member in the forum and i am following it a couple of months now. Foremost, I would like to thank all of you for the help you provide with your answers in the forum; You have helped me a lot, and as i see many other people in here.

My first concern is about my lawyer. I am a USC's spouse and before we apply for a GC we had heard a lot of situations of people that they didn't have filled their applications the right way and result them to have problems with their cases. So, we decide to hire a lawyer to do it, to make sure everything would be right from the beginning. Even though, at the begging our lawyer looked good and doing everything the right way. I released when my EAD arrived that he didn't have applied for an AP as i had constantly asked him to do. He had insured me three times that he had done the application with my I-765 form. When i asked him what happened he started making excuses that didn't make sense to me, because thanks to this forum and the official site of USCIS i knew he was lying. He told me like 3-4 different things as an excuse in 40 min we were at his office. My grandpa is sick and i was expecting this combo card most than anything else. I know it is not warranty of re-entrance but i wanted just in case if something very bad happens with my family to be able to go; as an emergency safety.

Then, I saw in this forum an interview of someone that had mark no on his application at the spot that says if you have worked before receiving EAD in USA even though he had. In the interview they asked him about it and he said yes . For him wasn't a problem, but because i have work with an ITIN number before my card i wanted to mark it yes on my application to make sure i am not going to have problem with that. I told my lawyer everything the first day we met him because i didn't want to lie at all at my application. Last night i reviewed my forms and i saw he had marked no there too.
So my question is: do you think that this could cause me problem in my interview?

And an other one concern i have is that my little sister is visiting us in 3 weeks with a waiver visa. In the application she had to put the name of the person she is visiting. So , I asked my lawyer if she can put my name on the application or my husband's. What would be better to do so she will not have a problem to enter the country, as i am still pending and not have a status yet, and i had overstay for 2 and half to 3 years. He told me it's best to put both of our names and that is what she did. But after all those mistakes he did i don't trust his opinion any more. Please if someone had similar situation or know something i would really appreciate your answer.

    My timeline:
    We filled concurrent: I-130, I-485, I -765 (apparently not a I-131)
National Benefit Center and i guess Newark ,NJ office for the interview.
    Received date : October 11, 2018
    Notice date: October 17, 2018
    Biometrics: November 15, 2018
Ready to be scheduled for an interview: November 26, 2018
EAD card approved: March 6, 2019
EAD on hand: March 14, 2019
and still wanting for the interview to be scheduled.

Thank you very much for any response in advance !

You should voluntarily disclose the incorrect answers that were on the form at the beginning of the interview.

Your sister should be truthful; she is mainly visiting you so she should say so.

This is my personal opinion and is not to be construed as legal advice.

Thank you for the response. That's what i will do when i will go for my interview. And for my sister of course she wouldn't lie , i was just wondering if it would be better to mention only my husband. To say that she is going to her brother in law. Anyway hopefully she is going to be ok. thank you again.
