  • I-485 interview in may 2018, still no approval

    Hi,

My employer applied for me employer based EB-3 AOS. I have indian passport but my birth was outside India, in Libya as my father worked there. The priority date was current after November 2017. Receipt date was August 2017. I got EAD card in December 2017, then they scheduled interview in May 2018 in Orlando office, but I am still waiting for green card.

Interview Officer said that she would approve but requested some tax return statements from me.
I sent those statements and it was received by them in June 2018.

Then there was still no response several months, then I scheduled Infopass appointment with Orlando office in November 2018. And in that appointment, another officer checked and said that he sees status approved but they were running out of visas so had to wait till October 1, 2018. After that USCIS is processing a huge backlog, but I should still get my green card by December 2018 - Jan 2019.

Now in recent months my local Orlando office has stopped taking infopass appointments. My company's immigration law firm said that they have to wait till date becomes current as per the site:

That site showed date of June 2017, and now it goes back to March 31, 2017 or April 1, 2017.
It is frustrating as the dates keep going back.

I see from some other forums that people get green cards within 1 week of interview.
Is there anyone from Orlando office, or someone whose case goes to Texas service center who can recommend how long it will take?
I'm not sure what options I have if the dates keep going back.
    I would appreciate any input.

    Thanks

Wow, I'm so sorry that is taking that long for you.

Do you think they made a mistake and listed India as the chargeability country? That could explain why is taking so long.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

Hi..Thanks for your response.. I'm not sure ..
I doubt they would do that after the Greencard interview, that was already done for me..

The lawyer are now saying that since Libya is listed in travel ban countries they are seeing lengthier processing times for these countries.
However, earlier when I checked with officer in Nov 2018, he said that the decision made on my case was approved.

Do you think it's worth calling the USCIS to check my chargeability country listed?

      Thanks
