  • Is it normal for an I-485 to take over 2 years?

    FILLED in New York

    Here is the story, I've filled for an I-485 in December 2016, did my finger print and from that point on things just became silent. I've called and emailed and no one seems to respond. So my question is: is it normal for this process to take this long? Also, I've called again on April 4th 2019 and willing to wait 30 days more, but after that I am going to contact congressmen/congresswomen and ask for their help. Also, I am thinking of suing the USCIS because I believe they lost my case, am I being rational, can I actually sue the USCIS?

    Did you file I-485 with other forms?
    If filed I-765 / I-131 did you get those approved?
    Did you file I-693? if not, did you get a courtesy letter?
    Did you marry an USC or is it EB?
    Did you move?
    Do you have online accounts on both websites?

    New York city office say the expected time (today) is from 20.5 Months to 32 Months, and the receipt date for a case inquiry is August 30, 2016.
    Nov 2018 - Package sent - EB - Texas Service Center
    Day 1 - Package received at the lockbox
    Day 999 - Card delivered to me - Aug 2021

      No, Didn't file the I-485 with any other forms except I-130,
      Pretty sure my lawyer filled the I-693
      I married a US Citizen.
      Haven't moved
      I do have online accounts.

        The problem with New York City is that you are still on "normal" time. If you contact your representative most likely they will answer that you have to wait until the receipt date for a case inquiry is after your filing date, sorry.
        If you filed I-693 you will need to take a new physical.
        Because you didn't file I-765 or I-131 then there is no other update on your case until they schedule the interview.

          Yes. it is normal these days for I-485 to take 2 years or more depending on which Category did you file in and which country was it from. Whats Not normal is - you only had fingerprinting done. They should have some movement on your case e.g. Interview Being Scheduled OR Case Transfer to another office etc. Generally, people do file Advance Parole and EAD together, so they keep getting some update on these two. In your case, you didnt file these two, so ..probably thats why.

            Ours took 19 months in AZ from filing to GC. 8 months for the EAD combo card alone.
