  • Question: Reschedule Green Card Interview

    I am a US Citizen & My wife came to the US on a Fiance Visa (K1) in June 2018 from Pakistan. We got married in July & sent the adjustment of status application (i485) to USCIS. After the Biometrics she received her Employment Authorization (with Advance parole approved) & was scheduled for an interview.

    Unfortunately Her father has been hospitalized with a life threatening prognosis and she wants to visit him immediately & this stay might be a prolonged one. I will also be staying with her in Pakistan while she is there as I can work from home.

    I will be greatly thankful to anyone who can guide us by answering the following questions:

    1. Can we reschedule the Interview simply by calling the number listed on the interview letter? (800) 375-5283
    2. Can we request the USCIS to Interview us in my wife's home country?
    3. If no to question 2 then, Is there a way to withdraw our Adjustment of Status Application & apply for a Green Card for my wife in her home country while we reside there?

    I honestly don't think she can be interviewed in her country seen where she applied from within the united state. And I don't think you should withdrew the application cause thisnmay cause her to loose her advance parol in that process and for her to reenter the US she would have to apply for visa or you may have to file for her which may possibly take years. May best guess is to have them send doctor medical information for her dad and then reschedule the interview for another time. Again am not sure about all of this so another opinion should help

    May 18, 18 - RFIE
    May 29, 18 - Both finger print done
    June 5, 18 - RFIE Received
    Sep 21, 18 - Case Is Ready To Be Scheduled For An Interview
    Sep 21, 18 - Interview Was Scheduled
    Oct 31, 18 - Interview complete
    Jan 18, 19 - EAD New Card Is Being Produced
    Jan 25, 19 - EAD Received in hand

      1.- Yes, I think you can reschedule by calling the number. You will get a new appointment in the future, maybe couple of months or maybe more.
      If she will travel with EAD/AP then she needs to enter the USA before the next interview date.
      2.- No, you can't ask to be interviewed on home country without filing another form
      3.- You don't need to withdraw the application but you will need to file form I-824 to ask USCIS to change from AOS to Consular Processing.

      I don't know your father in law condition, but I think, in your case, I will reschedule if the EAD/AP still has many months left on it. File I-824 if you plan to stay more than 9 months, don't know how long the consular processing will be in Pakistan.
