Form I-485 - Adjustment of Status - Part 2 Question

Hi everyone,

I've been reading through this forum while in the process of preparing the I-485 form for my wife.
I am U.S. born citizen and was recently married to a Japanese citizen in October 2009.
She is currently in the U.S. on an OPT visa and we would like to file the I-485 as soon as possible.

I would like some help in answering Part 2 (i.e., Application Type) of the I-485 form.
I'm not sure which box she should be checking in Part 2 of the I-485 form.
We will be filing the I-130 form concurrently with the I-485 form.
Should she be checking:
(a) An immigrant petition giving me an immediately available immigrant visa, or
.
.
.
(h) Other basis of eligibility.

Actually I am in that same predicament. I had written (b) but it really could be (a) since a number is automatically available for spouses. Hope someone answers soon.

Hi, my I-130 form application has been approved only online & the USCIS didn't mail me back the official approval note , Now I'm ready to apply for I-485 but I have question in my case should I attached the approval latter with the form I-485

Its called an "Approval Notice". You may try to file one without it but most likely will delay as they will request that or will not accept your application in the first place. You are required to send a copy.

I would call USCIS and request a copy of the I-130 Appoval Notice. And then send in your I-485 application with it.
