  • case closed benefit received by other means

    Good Morning All,

    I am reaching out to see if you all have had anything similar to my current situation, if so, please do share your experiences. Thank You.

    Now on to my concern;

    I am petitioning my mother for permanent residency. She is from El Salvador so she has a work permit under the TPS program, we submitted her I485, I765 & I131 all at the same time through a lawyer. This morning, on April 15th - I received notice that the I765 case was updated to the status listed on this topic "
    case closed benefit received by other means". We also received a notice in regards to her I485 where they told us we were missing her medical examination and that we could bring it in at a later time? We didn't submit it because the lawyer told us to wait until she told us. I'm sure it has something to do with the fact that the examination is only valid for 1 year and processing times for GC Interview are taking up to 18 months anyways.

    My concern is, why would the I765 be closed if we're submitting it under a new category? will her current work permit be changed and her travel document be sent to her? should I just call USCIS and ask to speak with a tier 2 officer? or just question our lawyer?

    Thanks much for your attention.

    My guess is that she has already a work permit, when is set to expire?. You didn't say if you filed I-131 (travel document).

    For the medical examination, that is common and your mother should do it before interview (now the medical last for 2 years) and bring the sealed envelope to the interview.

    You should question your lawyer for more information.
    Nov 2018 - Package sent - EB - Texas Service Center
    Day 1 - Package received at the lockbox
    Day 999 - Card delivered to me - Aug 2021

    All my posts are based on my experience or information I read on the forums or the USCIS website. I may be wrong. Please consult a professional.

      I meant to put i131, not i130 lol. Her current work permit is set to expire 09/09/2019 as per the current immigration laws, the TPS is being cancelled for her country. Thanks for your response and I will definitely contact our lawyer.
