Question on switching jobs while on EAD
Hi Guys,
I140 approval date: 03/2007
I485 application date: 07/2007
I am currently on my 10th year on H1. I have the following questions
1) Can I transfer my H1 to another employer if the new employer is willing to do a H1 transfer?
2) I am currently filed on EB3 with my current employer. If I move to a new employer will I be able to switch to EB2 with my EB3 priority date? I read somewhere that this was possible.
3) My I140 was actually a substitution case does this make any difference when I try to transfer my H1 or with maintaining my I485 when I join the new employer
4) I don't have my LC or the approval notice for I140. All I have is receipt numbers for the 140 and 485 application. I am not sure if I will be able to get that from my current employer. Is this going to affect any of the above?
5) Can somebody confirm that if an AC21 is filed by my new employer then even if the original I140 is withdrawn (by original employer) my 485 continues to stay valid right?
