  • Moving while applying for AOS

    Hello everyone,

    We're currently living in Orange County, CA. We sent our papers for AOS about two week ago. However, now, my wife suddenly wants us to move back to San Diego because her parents just bought a house there and they have some empty room. She said that it would us some rent money (our rent up here is almost 1500) while she studying and getting her eyelash certification there (She decided to learn eyelash and want to open her own business). And I support her, so we decided to move back there in September.

    However, here's the questions: I'm currently on F1 status, and I'm still attending school (where I learn to be a mechanic). I'll be finishing the program on Fall 2019, which is the next semester. So should I stay up to finish the program (end on December) while my wife moved down there first. Is it gonna a problem when we go to interview? And if we moved down there, what happened to our case? Is it gonna transferred to San Diego office?

    Any advice?

    I'm not sure about your education question but as far as the Field office goes, usually your case moves to the office that belongs to where you live.
    I moved from DC to Central VA and my case moved from DC to Norfolk for instance.

      I'm all for finishing the studies but also to be with your wife, so can you continue and finish your studies in San Diego? Can you wait to move after graduation? Or can you move with your wife and travel back and forth to complete your last semester? in a cheaper apartment.

      You don't need to keep F1 status. In fact, if you receive EAD you can tell the school to close your international student file and you can legally start working. So don't worry much about the F1 status.

        I was thinking about staying at my friend's house up here to finish the program, then move back with my wife later (She moves down there before I do because her eyelash class is scheduled on September). And if I do that, do I still keep the address up here until or do I change it when my wife moves down there?

          My guess is that they will ask for recent documents with your current address, so make sure you have the correct address on the important documents (wife's address or friend's address).

            Your Notice of Action (NOA) receipt does give instructions on your very question.
            If you move, you have to send immigration information of your new address. This has implications on which Field Office will handle the next steps of your AOS i.e. GC interview. If you are pretty confident that you'll get an interview schedule within the period you are still in school in OC then dont change your address. But my recommendation is since your wife is the AOS petitioner, her new address in San Diego should used to update your AOS information.
