Adjustment of status for a child of a US citizen entered on VWP

I am a Naturalized citizen, i have a baby boy that was born out of wedlock in the D R before i was naturalized. My child has a German Passport and entered the US with me on a VWP/ESTA a month ago. I want to apply with forms I 130 & I 485 but now am scared that he could be deported. I do have sufficient evidence that he is my Son. What are the Chances of Deportation of a Baby? thank you

Your child is eligible for AOS. They do not usually deport people who have a pending AOS for being out of status. In the highly unlikely chance they decide to deport him, he does not get a hearing in immigration court since he entered on VWP.
