    I have an approved I-140 with company A..
    Currently I work for another company B.

    Company A has asked me to get them business with out which they will not file my 485

    Is it possible for me to file 485 , with out the knowledge Of company A..
    Fortunately before leaving company A , I took copies of the Labor & I-140 approval.

    Can company A cancel my I-140 , incase i file 485 through another attorney of my choice.

    Please advise.

    Hi Defjam-

    Company A may withdraw your I-140 petition. All they have to do is send a letter to the INS asking them to do so.

    It won't really work to try to file an I-485 without Company A knowing. There are too many points at which the INS might find out that the relationship between you and Company A @#%$'t really stable. Especially now with the economic situtation what it is, they're really on the lookout for that sort of thing.

      you'll need a letter from co.A to file 485. Also, once 485 is approved, you'll have to go back to work for them. so if possible, try to revive the relationship, and tell them that 485 is for the future job, so it won't matter now to get the business for them (unless you are going back to them on H-1). try to convince them that at the time of 485 approval, you'll get the business, else they can fire you!

      I think after 485, if the co. fires you on the ground that the economic or whatever situation is differnt now, and they do not want you, you'll be free to join any co. on your GC. Do not do this intentionally though.
