  • Affidavit of Support forms along with AOS

    Hi,

I am in F2A category and i have my I-130 pending with CSC.Now i am preparing to file AOS as per the latest date of filing chart.
My wife is the petitioner and she don't work.I(beneficiary) work and i have an income.

    My questions is :
While applying for AOS ,i plan to file Affidavit of support forms too(I-864/I-864A).
Do i have to file for joint sponsor or can i myself be the sponsor and file appropriate form ,since my wife(petitioner) don't have an income cannot sponsor me?
    Please advice.

As the intending immigrant, you are part of the petitioner's (your wife's) household, and your income can be counted in your wife's household income on her I-864 without you needing to fill out an I-864A. You would need to show that you are working in the US legally. If after adding your income, your wife's household income is sufficient, no joint sponsor is needed.

This is my personal opinion and is not to be construed as legal advice.

Thanks for the reply newacct .
I have a question which is related to the same question.
If i include my income and then my wife's house hold income is sufficient, then she can file for i-864 without me having to fill out an I-864A.
If my EAD expires by Feb 2020,and if my AOS is in pending state at that time, then it can be a problem or not.?

I believe that AOS will get approved only after I-130 gets approved, even though i apply AOS early as per the date of filing chart.
So i think my EAD will expire before my I-130 gets approved.

      Any thoughts?

Well you should also apply for an AOS-based EAD and AP, both for free, along with your I-485. So you should get that EAD by the time your current EAD expires.
