RFIE pending but interview scheduled

Hi,

I was issued an RFIE—this stupid issue with a J-1 visa I had in 2010 where they need me to prove I wasn't subject to the two-year foreign residency requirement—but I also just got a notification yesterday that my interview was scheduled. I don't know when, yet, because I don't have the letter yet.

Has anyone ever experienced this—having an interview scheduled while an RFE/RFIE is pending? My lawyer says I can just bring my response to the RFIE to the interview, or submit it afterwards if what we need to respond doesn't arrive til after the interview, but I wanted to check and see if anyone else has had this experience. It feels like everything is happening out of order. I never even got my work permit.

Your interview should be around 5 weeks from status change to 'interview scheduled'. You should receive the letter after a week from the change.
I think that all RFIE has a date when you must submit it (before X date).
If the RFIE date is after, let's say, July 5th then I think your lawyer is correct, you could wait to send it until you have the documents you need after the interview.
If in your interview they ask about that, and you have it, then I guess you can give that to the officer, if not, just explain that you still have time to submit it and you are waiting for X document to complete the RFIE.
