  • Question about "Is this child applying with you" on I-485

    I am a naturalized citizen applying for GC for my wife and our son. My wife is on an H1 visa and son is on H4 visa. I am not sure how to answer the question in form I-485 Part 6 Question 6 "Is this child applying with you". Is this question for derivatives? Since my wife and son are both Immediate Relatives, is it wrong for me to answer "Yes" here. They both have their own I-485 with each as a primary beneficiary. This has an impact on the fees as well since if I answer "Yes", I can send both their forms together and pay $750 for my son instead of $1140. Looking for someone who is a citizen that has applied for spouse and their own (not step) child. Thanks

    Family Members
    If you are the spouse or child of a U.S. citizen’s immediate relative, you must independently qualify for a Green Card and file your own application. You cannot qualify for a Green Card as the derivative beneficiary based on the immediate relative’s application.
