DUI Record Question

We are in the process of filling out the AOS documents and one of the questions is wether you've ever been arrested or charged with a crime. My husband (the petitioner) has had a DUI over 5 years ago, which has since been expunged and completely taken off his record. So should we answer the question with No? Technically he has been arrested, its just that the "crime" was forgiven and taken off his record.

He's petitioning for you? If so i wouldnt worry about it too much, USCIS only cares about crimes the applicant commits.
Probably best to put it on the form and not lie about it

The beneficiary is the one that fills out I-485. None of the questions are for the Petitioner.
