  • RFE Response Delivered 74 days ago, still No Update. Am I Being Denied??

If you're from Atlanta/Georgia you probably already saw my post there.

So my husband and I already had our interview on 2/26/2019, that's almost 100 days ago. Everything else went well, officer was a nice pregnant lady who obviously thought we were a cute couple, and the i-130 was approved 1 day following the interview. However, the interviewer said my birth certificate wasn't the format that could be accepted, and that I had to get the birth certificate notarial and printed out an RFE. (I filed everything myself, didn't get a lawyer and didn't do any in-depth research on different formats of birth certificate)
My heart sank a little, but officer was pretty helpful and even printed out the page of instructions of where and how I can obtain the notarial. My husband asked her "how long will it take to get an update once we send in the document", officer literally said "well it depends on when we look at it".......

Fast forward to 3 weeks later, I took care of that and sent in the requested birth certificate notarial on 3/21/2019, it was delivered the next day.

Now it has been 74 days since it was delivered, and yes I kept the receipt and have proof of delivery. Atlanta field office did NOT EVEN bother to send me a notification saying "RFE response received case under review" or anything like that. Status is still "interview was scheduled".

Atlanta stopped taking info pass this year, so I called USCIS level 2 officer a week ago and he put in a service request for me. A week later on 5/31/2019 I got an email from Atlanta saying my case is still pending and I should receive a decision in 120 days. Like WTF......

So possibilities are, my original officer went on her maternity leave and she transferred my case to a new officer, who obviously doesn't give a damn...
Or, she did not transfer my case to someone else and my case is just sitting in her office taking maternity leave with her....
Or, she's already back to work and totally forgot about my case....
Or, my RFE response is still sitting in their mailroom, nobody has even touched it....
Or, they're gonna tell me they didn't receive the notarial and deny me......

Anyways, my husband contacted the congressman a couple days ago in my district and we're still waiting for a response.

Am I being denied??? Like what is it about it that can take this long???

Sorry for the long post guys, I'm obviously freaking out, and thanks for reading!

Are you close to your 2 year marriage anniversary? Maybe the officer wants to wait to give you an unrestricted 10 year GC. Good luck, I hope you get approved soon.

Nah, we're at the 1.5 years mark, and thanks! I really hope they won't deny me

How did your husband contact the congressperson? Was it email? Considering the time sensitivity, you should first contact your local congressional office over the phone to see if you can get an appointment. You can also show up in person during business hours. Make sure you bring all the documentary evidence you need with you. I'm saying this because I once contacted my congressperson by leaving an email in their general inbox listed on their website. Yeah, those inboxes are rarely monitored. Call their office or show up. Squeaky wheel gets the grease!

It could be all of the reasons you have stated above but it does not mean that you will be denied. USCIS is taking extremely long on everything especially when there's an RFE. It takes them longer when they ask for more info. Not sure why. Wait a bit and if it turns out to be too long since you sent in the RFE, you could go to federal court to ask the Judge to order them to make a decision.
This is not to be construed as legal advice or the establishing of an attorney client relationship.

Thanks for the advice! We'll call them today to see if we can get a hold of a real person. If not we're going to their office.

Yeah I feel like they're extremely understaffed, I saw a couple of people that filed from ATL got their interview scheduled in Alabama and South Carolina.. My EAD expires in 3 months, we're gonna go visit the congressman soon and demand an answer.
