  • Not enough proof of bonafide marriage. Please Help!!!!

    Hey everyone,

I have been a long time reader of this forum and finally posting my first topic.

So FINALLY, me and my husband are planning to apply for my green card. We are in a same sex marriage and we have been married for almost 4 years now. I came here on F1 but ran out of status.

We went through a lot in those 4 years since I am not able to work and he has been the only one looking after everything. We couldn't apply for my AoS because of lack of funds and when we did, we got RFE since my husband's income wasn't enough, so we just abandoned the case. Thanks to this forum, I found out that someone else can also be a joint sponsor and now my mother in law will become our joint sponsor.

Unfortunately, because of my bad credit, no identification, we don't have enough proof of bonafide marriage. We couldn't open a joint account because we both had past derogatory marks on our checking accounts. When my husband managed to open an account recently with webster, they refused to add me because I don't have any valid ID.

Also, because of our financial circumstances we didn't go out for a vacation. Just here and there, museums, zoos etc, we have photographs.

We are on a tight budget, so I don't even have a phone, just ******** that we use to message each other. We have section A, so I can not even be added to the lease.

The only proof we have is:
    1) Car isnurance cards with both of our names, since 2015 to date
    2) I am listed as authorized user on my husbands credit card
    3) Affidavit from friends and family
    4) Photographs
    5) Joint tax returns for 3 years
    6) My mother in law is a joint sponsor.

I am really stuck, I don't know what to do. I am really going crazy just sitting at home. I really want to help my husband. His health is also declining because of all the things he has to worry about.

You seem to have sufficient proof. I wouldn't worry too much and send in the application. Its not the quantity that matters, You only need enough proof that explains your bonafide' marriage. If your sponsor has enough to support you above the federal limits I wouldn't worry.

You have two more years once your submit application to gather proof. Do that. Once EAD comes get yourself a job and better your lives. Good luck.

It sounds like you have sufficient proof!

If you can, I'd also tell you to add copies of your lease agreement (or if you live with family, a letter from the family member stating that you guys are living together) to show that you're living under the same roof.

If you're filing tax returns in the US, it means you have a TIN, correct? Also, how are you on the car insurance with no valid drivers license?
