  • Current rules on i-683 help!

    Hey guys!

    My lovely new wife and I are almost ready to hand in our concurrent adjustment of status application! It's exciting and terrifying and has been downright stressful, doing it ourselves without a lawyer and being so worried about getting anything wrong.

    My only concern at the moment, is whether or not we need to file the i-693 medical exam at the same time.

    I know in the past you could file it later, or bring it to your interview. I am now reading mixed information - that last year they changed the rules and now want it filed concurrently.

    There seem to be a few folk on both sides of the argument.The way I read it is that you CAN file later, and that you simply can't get the medical MORE than 60 days before application.

    Can anyone please help, because this is all we need to be sure of in order to send the application in!!

    What I understand is that if you want to file all together, you need to send the package with all the forms and the sealed envelope from the doctor before 60 days after they sign the I-693, that way the form will be valid for 2 years.

    From what I read, most cases for people married to USC get the interview and green card in less than a year, so generally is safe now to send the form with all the rest.

      Thanks for the response. I'm hoping to send the medical in later, or bring to the interview - as this process has so far cost a fortune as you all know, and it would be more comfortable being able to take some time to get some more money together for the required vaccinations and medical exam.

      I read the instructions for the i-693 differently and to me it suggests you can still send them later - but I see some people adamant on both sides so I'm a bit lost.

      From the USCIS page under 'where to file' :

      If you are applying for adjustment of status, you may submit Form I-693 in one of the following ways:
      • Submit Form I-693 by mail, together with your Form I-485, Application to Register for Permanent Residence or Adjust Status, to the location specified for your Form I-485 (see “Direct Filing Addresses for Form I-485”).
      • Submit Form I-693 by mail, after filing your Form I-485, to the location specified in your most recent communication with USCIS (for example, a Request for Evidence letter from USCIS).
      • Submit Form I-693 in person, at an interview in a USCIS field office (if an interview is required).

        You have 3 options:
        - send it with the I-485
        - send it to answer an RFE that request you to send it (most RFE will tell you to submit in person at the interview, this is know as "courtesy letter")
        - submit in person at the interview

        When you case status change to "Interview Scheduled" then go to your civil surgeon to make an appointment and take the results to the interview. Most of the time your interview will be 5 weeks later.

          Thank you. That's how I read it too. There's an alarming number of folk out there that have misread the rules in this case (if we are in fact correct!).

            We didn't send the I-693 with our I-485 package. We just received a letter that say that we need to contact an authorized civil surgeon to get the medical done, a little over 6 months since they received the forms.

              Hey, if you aren't already aware, google "Civil Surgeons who DON'T rip you off" and you'll come across a thread on another forum. We used that as our starting guide and the Dr. we went with charged us the least by far. Good luck!
              2018 Marriage-based AOS (I-130, I-485, I-765)
              07-09: Package Delivered to USCIS Chicago Lockbox
              07-17: NOA texts & emails (~10:30 pm)
              07-17: Checks cashed
              07-20: 3 NOAs received in the mail
              07-27: Biometrics letter in mail; scheduled for 08-08
              07-30: Biometrics done; USCIS received on 07-31
              08-02: RFIE for proof of legal employment; replied 08-04
              08-08: USCIS received RFIE, case no longer on hold
              10-04: AP approved
              11-28: Case Ready to Be Scheduled for Interview
              11-29: EAD approved
