    My employer filed my I-140 through employement based in 2011. My lawyer submitted my 1-485 in 2012 as they applied cross chargeability(CC) and thought I was eligible as my spouse is from a country which had priority date current but they missed the fact that CC cant be applied because my husband was not applying for a AOS with me. So it was incorrectly filed.

    They realized this but by then USCIS in error approved the AOS. I asked them to follow up as I knew this was incorrectly issued. They contacted the SC twice and got back to me that it has been approved based on CC and I am good to go and should hold on to the GC.

    Now, I applied for citizenship and my application got denied stating Failure to disclose inadmissibility at the time of AOS.

    I have time to appeal as I am within 30 days. My lawyer has the service center WAC# on the calls they made to confirm that it was not an error.
