My husband (UK) tried to apply for an adjustment of status back in 2016, and his application was in process for over 10 months. During that time, we had a change in financial circumstance and had to return to the UK and he cancelled his application. We are supposed to be visiting family back in the states this summer, and I'm not clear on whether or not he's going to be able to join us. It says you cannot apply for an esta if you've overstayed in the past, however I do not know if it counts as him overstaying as he had an adjustment of status application in process during that time. Does anyone have any insight into this? Would he be accepted for a visitor visa in this circumstance if he cannot come in on an ESTA?
