  • Help answering RFE (wrong i-864)

    I just received an RFE that states that our income does not meet the 125% federal poverty guidelines (which it does) but also asking to re-submit form I-864 because there were deficiencies in the one we provided.
    I found one issue with the one we provided and one other possible issue. First one is that we made a mistake when adding the household size (we added items 2-7, not 1-7). The other possible issue is that since my wife is now unemployed (homemaker), her income doesn't match what the taxes say (and they asked us to submit her tax return + all supporting docs again). Her last income taxes says a number of about 40k but the current income says 4k (income that we will claim in next year tax return from having worked January) and she's now unemployed. My income as a grad student is 10k above the required guidelines anyways so I doubt that was a problem. We also didn't claim any assets which we have (18k in a joint account).
    How would you fill out the income part in this case? Would you claim current income as 0 and include the money in the assets? That way the income would be about 37k when considering mine + assets. Or would you still claim 4k for her given that she worked in January and we will have to claim that income in the next tax return we file together?

    This is my timeline so far:
    04/24/2019 Application sent to Chicago
    04/30/2019 Application received by USCIS
    05/04/2019 Received NOAs in the mail
    05/12/2019 Received biometrics appointment letter
    05/22/2019 Biometrics appointment
    06/22/2019 Notification that RFIE has been mailed
    06/28/2019 RFIE received (request for new i-864 and i-130a (forgot to send it!))

    Does your spouse get unemployment? That is income and is taxable. I believe you can use your savings too. Put ALL the info requested and see how that works out. Your income does not really count on a 864and is for the sponsor because they will have to guarantee the government they will support you and agree to reimburse the government for any welfare benefits you receive. Or something to that effect.....

      Hi! Thanks for answering! No, my spouse doesn't get unemployment. She quit to be a homemaker instead and is pregnant. We will use our savings then but the instructions for the i864 do state that my income counts towards it as long as it will come from the same source after immigrating. In my case, I've been in the US for 3 yrs already in a graduate program and the end of the program is listed as 2022 so that shouldn't be a problem. I have tax returns for the past 3 years and I have pay stubs from this year plus I could get a letter from my employer too.
