  • About to file AoS, wife had to move to another state temporarily

    Hi all,

I am planning on filing an AoS based on my wife being a USC. I have all the necessary bonafide marriage proof - joint property ownership, jointly filed taxes, car insurance, health insurance, jointly owned vehicles, pictures, life insurance, utility bills, etc. But the only kink is that my wife is working to become a doctor, and she just started her medical residency in another state. Medical residency is something that is hard to find exactly where you live and most people invariably do it in another state. I have her offer letter from the residency hospital describing that this will last 3 years, and soon will have paystubs (she has only been there less than a week). We plan on visiting each other very frequently, so I'll have plenty of plane tickets to show if necessary. I have also added an attachment to the application explaining why the address is different, and that this is a temporary arrangement that will last 3 years.

What kind of problems can I expect, if any, when I file for AoS? I have filled out the I-130 application with her address in the other state. Is there anything else I should mention on the application?

Thank you all, appreciate all the help I can get.

I doubt you will incur any difficulties. Just keep all the plane ticket receipts and even restaurant receipts if you guys go out to eat when you visit her. Take pictures! Whatever activities you do in her state she is in just keep a record of it. You will be fine.

Thank you for the advice. I will make sure to take pictures at the very least.

Edit: Another question I wanted to ask. The I-130 form contains the question:

"The beneficiary is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the U.S. Citizenship and Immigration Services (USCIS) office in:"

For this question, should I pick the field office where I am currently living or where my wife is currently living?
