  • Request for Further Evidence

In 2005 while a foreign student I didn't see or stop at a stop sign. I was driving without insurance or registration ( Can't remember if I hadn't insured the car and had no registration or if I just didn't have the paperwork with me). I was given a ticket or tickets and I guess I was supposed to appear in Court but I didn't pay or appear ( Honestly through oversight)which resulted in my license being suspended. I was pulled over in 2006 and charged with driving on a suspended license. The City Attorney had the two former counts dismissed and counseled that I plead guilty and pay a fine. I did. I filed I-485 did the interview and was told I only needed updated medical report. Now they also added a request for further evidence about the case. USCIS is requesting arrest report etc. I was not arrested but they courts told me they cannot write me a letter attesting to this. They said that the court docs will not include an arrest report and that should be sufficient. The whole thing is a bit confusing. Should I send them the motions to dismiss the 2 charges ( no registration , no insurance) or just send the docs regarding the suspended license abd the fine. Is this considered a plea deal? They've asked for alot of things and I'm not sure if i have everything requested. I also noticed I didn't see anything in the court docs showing that I paid the fine. A criminal history report showed I paid a fine but the amount was different that what was on the court docs. It's all confusing. Please help!!!

You are in the same ball game as I’m but I provided all the documents they requested. You definitely need to send them a receipt showing that you paid the fine. They NEED that and plus all the documents the courts can provide. It’s a roller coster as your case is so old. If you have the money to consult in a lawyer please do because if you don’t send them what they want your case will be automatically denied.

You will need a certified copy of your court records and write a letter explaining the results and if there law code in the record you'll need a copy of that law where the code is and explained as well. Pretty much you have to do their job and give them everything well explained and documented so they don't need to look for something or excuse to say they can't make an informed decision.
