My wife is a US citizen and I am adjusting my status. We were told by a lawyer that along with i130 and i485 I needed to file the form i765 for work permit. the problem is that I don't seem to meet any criteria on that form. am I missing something here? I am not seeking asylum. Do I need to file this form or not. I would ask the lawyer but we were told she couldn't help us unless we became clients. I am strapped for cash and need some guidance. Please if anyone can help please do so.

if you want or have to work, while your I-485 is pending..
NO obligation to file I-765, if you do NOT want to work, until the decision about your GC is made.
Maybe you're retired and don't want to work anyway ? -

Hello dear, if your wife is filing for you, you are qualify under C09. What do you mean by I do not meet any of the criteria? If you are qualify for AOS, then you are qualified for I-765
