  • Right way to marry a US citizen. Please help!

    Hi there,
    I’m in US on a tourist Visa planning to marry my long term boyfriend who is a US citizen. He just proposed me and we had a celebration party with my parents and family (we all are visiting on B2)

    In terms of getting married and taking a next step I wanna do everything legally right and safe. Please help-

    Option 1- Its been 2 months already since I’m here. Shall I go back het married in my home country and come nack on a fiancé visa.

    Option 2- Shall I stay back in US and get maried in US and adjust the status.

    Option 3 - Shall I get married in My home country but not register my marriage and travel to US on a tourist Visa after home country ceremony and wait in US for 90 days and get married/register marriage.

    I wanna spend least time in my home country also I def wanna have a ceremony in my home country. What shall I do. Please advise!!

    I think that, if you entered the USA without the intention to get married then is not a problem to marry and stay in the USA to adjust status. You can do AOS and file I-131 to be able to travel during the process. Depending where you going to live in the USA the process could take less than 6 months to over a year, you may get the EAD/AP or not before the GC. So don't make any plans to have a party in your home country that you may need to cancel.

    If you decide to go back and marry there, then your husband will need to file I-130 for you and with the receipt then get a K-3 visa for you (the page I visited say between 6-9 months but could be more).

    Definitely don't get marry in your home country, don't register your marriage and travel on tourist visa.

      We got legally married in the US and started the AOS process. Once I got my Advanced Parole and was able to travel, we went back to my home country and had a ceremony there (with no legal component as we were already married in the US). I agree with Enub4 - make sure that you register your marriage in the US as opposed to your home country. It will make your life a lot easier. We were also able to spend a year planning our ceremony in my home country while my AP was being processed. Our lawyer's general advice was to start the immigration process as soon as possible as timelines are becoming crazy.

        I'm a US citizen. My wife was here on a B-2 visa before we got married. She entered with no intentions to get married. We were able to prove that and applied to adjustment of status. She received her conditional greencard within 6 months of applying for AOS. We submitted a lot of evidence of our relationship. She stayed here for 3 months on her B2 before we got married. (30-60-90 rule) and applied shortly after. From start to finish, it took around 6 months for us, I know this is a lot faster than some cases but i have good income, work for federal government, and clean record with no issues. So that might have helped the case. We will be applying to get her conditions removed within 2 years.

        Honestly, Option 2 is a better option in my opinion. Option 1 not possible. and I would not even consider option 3.

          1. you can not get a fiancee visa after getting married.
          2. you can do that.
          3. No no no

          If you want to have a ceremony at home the simplest thing is to get married here ( civil courtroom). File your AOS including advance parole. When you receive advance parole go home and do the ceremony then.

            Could you please tell when did you apply for you AOS I meant what year, Also how long it took you to get your Advance Parole.
