Spouse 485 Approved but in India can she use H-4 (has stamp) to reenter

Wife's 485 Approved but she is in India with valid H-4 visa stamped in the pasport

Here are my details,

Applied for Labor in Dec 02,
Got LC in Aug 03
Applied 140/485 in Dec 03
140/485 Approved 18 Nov 04

The experience so far getting thru the GC process was far better than many ppl I know.

I just checked my wife's 485 status - and it is showing Approved. I have to still recieve the papers by mail.

My wife is currently in India - travelling on H-4 visa and she has a valid H-4 visa stamp till March 05.

She also has a valid Advance Parole valid till last week of December 04.

She is planning to come back to USA in Jan 2005 on her H-4 visa would that be a problem since she has got her 485 approved ?
Would she need to prepone her trip to come back to USA on Advance Parole which is valid till Dec end.

Is there any option of getting the I-551 stamped in the passport in Mumbai ?

Did u receive the approval notice by regular mail. Mine also got approved on 18th nov 2004. When can we except the approval notice by mail.

If she has NOT used her advanced parole before and she has ONLY used her H4 to reenter the US then I would not worry and let her come back using her H4.

If she has used her ADVANCED parole before then FORGET about using the H4 to reenter. In that case I would make her come back to the US and use Parole. Trip must be complete BEFORE the experation date.

Remember Trouble comes when you start using parole and Hs visas at the same time. Once you use parole for the first time then you can not use h visa any longer.

Quick question where was your 485 filled?? Texas, VERMONT???

she will come back on H-4

No she has not used AP /EAD before.

She is going to come back on H-4 the only thing I was not sure was if I shud go ahead with the I551 stamping or delay it till she comes back.

I am in Atlanta, TEXAS service center my 140/485 receipt date was Dec 02 2003. Approval date 140/485 18th Nov 2004.
