693 medical valid on interview date but expires soon.. retrogression

    Finally got 485 interview notice for aug 5,2019. But eb3 priority dates have retrogressed. So looks like I willl have my aos interview and will need to wait for priority dates to become current.

    Meanwhile my medical 693 expires aug 17 (1 year rule since I did it last year before new 2 year rule took effect) Medical is valid on day of interview but expires a few days after. So when my priority date becomes current day in October my medical would have expired.

    should I re-do medical proactively before interview even ?

    Can you share the date when the civil surgeon signed the form and the date they received your I-485?

    Because your I-693 was filed before November 1, 2018, then you need to look if the civil surgeon signed the form less than 60 days between the physical and the I-485, then the form is valid for 2 years. If the form was signed more than 60 days before submitting I-485 then it is only valid for 1 year.

      Letter signed 8/17/2018
      485 receipt 09/04/2018
      initial refs response accepted 03/26/2019
      interview date 08/6/2019 but priority date is not current in day if interview so possible wait for a few months after interview for approval

      my understanding was 2 year validity of i693 is only for cases filed after nov 2018

        That's what most people understand reading the general information (including me), but after reading the page I linked and looking at the chart for forms submitted before November 1, 2018:

        you can see that your case is the one in the second row.

        I have read that some officers still fail to fully understand the change, so there is a chance that the officer may say that your physical will soon expire (before GC approval because of retrogression) but you can print the information and highlight the chart's second row. I hope your officer is fully aware that your physical expire 08/2020.

        Good luck on your interview and I hope you get your GC in October.

          Another pertinent question is - does it need to be valid on interview day, or valid on the day they decide to approve/issue you a gc? I don't think this is ever clarified in USCIS website

            Must be valid on the day of the interview. If 693 expires, say 10 days after the interview day, and a supervisor reviews the case 14 days later, they may still issue you RFE but that would be because the supervisor is incompetent.

                Thanks! We are helpless I guess since we are not present to show any specific link to this when the decision is being made

                  I cannot afford to have my case delayed by ambiguity so I went ahead and got 2 new medical exams anyway (mailed one to USCIS field office and will carry another for in-person interview).
