  • Basic Questions...The confusion of it...

    Hi Everyone!

Sorry to bother you... I have a couple of questions and my research has not gotten me anywhere as there is so much conflicting info out there... So here are my rather basic questions:
My ead is about to expire and I am currently preparing the I-765 form for the renewal of my EAD.
I am currently awaiting our greencard interview.I have gotten married to U.S. citizen on June 1st 2018 and filed the I-485 on the same date. I have entered the U.S. a week prior to this on the ESTA/visa waiver program.
My question now is: What is my current visa status, as it is asked for on the I-765 Form under No.25? (do I put adjustment of status?) Also for the question pertaining to what my visa status was upon arrival to the U.S - do I put ESTA/Visa waiver?
And lastly, do I need to pay the 410$ filling fee? (btw my category c09)

And on another note,is it true that if you had your medical exam done within a month of filing the I-485 it is valid for 2 years and not the regular 1 year?

    Thank you so much!!!

From what I understand you do not need to pay the fee, just attach your I-797 from your I-485. Your visa status upon your arrival will say on your I-94, do you have that on? And yes, medical exam should be valid for 2 years.
I am wondering though, are you prepared for USCIS asking you if you planned to come here and get married and stay? I know that people always advice to wait a couple of months before filing for the AOS because otherwise it could look like you planned this from the start.... especially since you already had your medical exam done.

Q#24 Immigration status on last arrival - it should match your answer in your original I-765 filed, if you travelled out of the border after your EAD/AP was approved, your immigration status should be “parolee”

Q#25 on the I-765 gives your options on the answer, so in your case it should be AOS c(9)

There is no fee to renew your EAD if you filed the original I-765 concurrent with your AOS I-485.

I-683 is valid for 2 years.

Just a quick note for you, as you wait for your GC interview, you might as well put together a really good pool of evidence that you and your spouse knew each other for quite some time before marriage. Im concerned your marriage on the same month of your arrival on ESTA will be raising red flags with immigration.

      Best of luck.

      Cheers.
