  • I-864a [household member contract]

    Hi all,
I'm the main sponsor for AOS of my wife.
I filled the I-864 form, but my income is too low to meet the requirements. I can use my father's income (same house), so he's filling one I-864a form, right?
Now, he fills his individual income jointly with my mother (same house as well). Is she required to fill another I-864a because they fill "married filling jointly" ? My father's last year and current income meets the requirements.

    thanks

Yes, 864A for him. If you are not using your mom's income, she does not need to file 864a.

I need to clarify one more thing....
I've already stated that my parents filed jointly the income, but I believe the "Total Income" on form 1040 (2018) is combined, not individual. I have to use that amount "total income" for 1040 as stated in the instructions, but send copies of 1040 files related just to my I-864a filler(household sponsor/father)? thx

          yes

This is my personal opinion and is not to be construed as legal advice.

Now I come back again with a new question if anyone can help .
My father (household member/sponsor/I-864A) owns an S corporation (sole employer of it). Part of his income is from his S corporation. Do I have to include proof of tax return/income on the S corporation? ownership proof of his S corporation? I believe they only asks for individual (a person can be a sponsor), but I want to be sure of it.

              thank you again

If this company is a source of his income that he is using to support you, then the answer is yes.
