We won't be able to file i485 during august, is that correct?

I'm about to file my i485 during the oncoming days (possibly tomorrow), via fedex. So is my brother.

However, his lawyer says not to worry about it that it doesn't matter.

Is it possible to file i485 during a backlog?

It depends on what is your eligibility for I-485. The link just tells you which date they have processed for different categories.

I saw your other posts and I guess your category is EB2-NIW.
If your brother is in the same category then I think his lawyer is wrong.
From what I read USCIS will return the application if filed in August.
