I-485 RFE Asking for birth certificate

Hello,

I-485 AOS. NYC. I received RFE asking for birth certificate. I was born in country A and became a citizen of country B. At that time, I added a English first name along with my native country A name. Its something like this :

Original name at birth : xxxx (first name) xxxx (Last name)
Current name when I become citizen : Felix xxxx (together become given name on my passport) xxxx (Last name)

Currently I have the following docs :
(1) Birth certificate of country A with original name. It is done with native language with notarized English translation
(2) Naturalization certificate and passport of country B with current name showing the Country A and also the city at birth as place of birth.

Are these enough material to satisfy this RFE ? Any thoughts are appreciated.

Did you include both 1 & 2 in your application packet, and still got RFE? If yes, then USCIS thinks you do not have enough evidence. Clearly, they want a birth certificate with your current name. Therefore maybe including a name change application (if it exists) when you obtained your passport might be a good idea.

Hello HPX3000,

i only included my naturalization certificate of my current citizenship with the application. On the cert, it shows my current name and place of birth. Unfortunately I do not have any doc showing application of name change. The only difference between my current name and original name is I added a English first name. I wonder if that will cause any issue with birth certificate showing only original name.

From what I read, you didn't send the birth certificate and you sent the naturalization certificate. They need your birth certificate.

Name changes are treated differently in many countries. Can you do a name change in the USA from your birth name to your current name? I don't have experience with that.

Since that's all the evidence you have, here's what I recommend and maybe someone else could suggest better ideas too:
1. include your birth certificate
2. have people close to you write affidavits saying that your birth name is different than your current name because you added a first name. 2 parents/grandparents + 2 family friends should be more than plenty.
3. include your naturalization certificate
4. include an explanation letter saying you changed your name in your naturalization certificate and/or current citizenship

No. 2 above might be an overkill but probably good to do more than less.
