  • GC through marriage

    My gf is a US citizen, we are living together (with a shared lease) since last month. We are also thinking of getting married soon. Would it be a red flag if we got married in the court, without any reception as we both cannot afford a reception.

    Also, I am on F1 and I do not have the money to enroll for next semester, so I am thinking of not enrolling and only depending my my gf for sponsorship. Is it a wise decision?

    My husband and I got married at court and did not have a wedding reception, no problem at all. As long as she's making over 125% of poverty line of your household size, you should be fine adjusting status.
    I was on F1 OPT (4 months away from EAD expiring) when I filed for adjustment of status, I personally would enroll in school for another semester so it would look better, but idk..

      how long does it take for the EAD to be processed if everything is alright?

        Several months. Many reports 6-9 months, but every case is different. Some people get the GC and the EAD was never produced.

        Day 999 - Card delivered to me - Aug 2021

          For me it took 6 months. Definitely file as soon as possible while your F1 status is still valid now that everything takes forever.

            No problem at all. Remember to take some pictures on the wedding day and file within your valid VISA period.

            BTW, your income does not count for the sponsor. It has to be your wife's income if you do not have other sponsors.

              I would file while you are enrolled. The big reception and everything isn't needed. Just take some pictures and you'll be good. How long were you a student for? Just so it doesn't have Dual intent issues if you were to file after one semester of being a student and then not enrolling in the next semester.

              11/20/18 - Sent package
              11/23/18 - Priority Date
              12/26/18 - Biometrics Appt. Completed
              12/31/18 - Case Ready to Be Scheduled for an Interview
              4/15/19 - Received EAD
              7/25/2019- Received Notice that interview was scheduled!
              8/1/2019- received Notice of Interview
              9/3/2019- Green card interview! Approved on the spot
              9/6/2019- Received I-485 and I-130 approval notices
              9/11/2019- received green card!

                I have been a student since Fall 16, been in the MS program for 3 years due to bad GPA. I still have one more semester to go, but we only have money for either school or to file the GC paperwork. I have a valid i20 till december 2019, but if i don't get enrolled for classes by sept 9(census date) the i20 will become invalid. I am still thinking whether we should put the money towards school or for my paperwork. I have a feeling that getting the GC paperwork done would be a good option, if i go back to school the it will take 6 more moths for us to come up with the money to file the paperwork

                  I would suggest you filing the AOS while your F1 is still valid. Your present will become legal after USCIS accepts your AOS files. But make sure you have more evidence showing you relationship is genuine.

                    Me and my wife lived together for 3 months before we got married on the court and i received my greencard within 5 months.
