  • Process for Medical Exam after I-485 was already submitted?

    Hi,

    I have submitted my I-485 AOS application in Sep 2017 WITHOUT form I-693 and my case is pending scheduling of interview. I recently went to get my medical exam completed and the Civil Surgeon said that the results needed to be submitted to USCIS within 30 days. Is this true?

    What is the process for the medical exam and submitting results when the AOS application was already filed?

    No, is not true. The medical should be submitted within 60 days if filing with I-485, because you did it after that your results are valid for 2 years from the doctor's signature date.

      Thank you for the answer. This was also my understanding.

      Do you know if I should bring the results with me to the interview or should I send these to USCIS beforehand?

        The i-693 has to be submitted within 60 days of being completed regardless of whether it is submitted with i-485 or on its own. So unless your interview is within 60 days of getting it done you have to submit before for it to be valid.

          That's not what the policy manual chapter 4 say:
          A. Results of the Medical ExaminationThe physician must annotate the results of the examination on the following forms:Panel Physicians


          This chart is pretty clear:


          In Muesli case:
          1. Already filed I-485 (benefit application)
          2. When did civil surgeon sign? After benefit application
          3. When the I693 is going to be submitted? After November 1, 2018
          4. I-693 retains evidentiary value through: 2 years from date civil surgeon signed I-693

          This is what the policy say about the 60 days:
          • The Form I-693 that the applicant submitted is signed by a civil surgeon no more than 60 days before the date the applicant filed an application for the underlying immigration benefit. Footnote 22: For example, Form I-485.
          because in this case the form is signed after form I-485, then is valid for 2 years and you can send the sealed envelope if you get RFE or interview date within those 2 years.

          Remember that the officer can ask for a new physical if they think that your health changed since the last physical even if still valid (I guess if you travel after the physical to countries with health alert or something like that).

              Questions:
              My lawyer forgot to submit my I-693 form along with the I-485 application. I had my medical done in February 2019, and filed AOS in February 2019. I'm expecting my interview in the near future since I just received a courtesy letter.

              Based on my understanding, since my I-693 form was signed less than 60 days before AOS filing (although it was not submitted), my I-693 form will still be valid for 2 years.

              Can anyone please confirm?

                rwilli I answered in your other thread. To try to make it a little clearer for you, let me add some information here:
                - when will you submit your I-693? at your interview
                - the interview is going to be after November 1, 2018? Yes
                - when the civil surgeon signed? February 12, 2019
                - did the civil surgeon signed no more than 60 days before filing AOS? Yes
                look at the chart, your case is the first one, so your I-693 retains evidentiary value through 2 years from date civil surgeon signed I-693.

                Because the envelope is sealed by the civil surgeon, it doesn't matter if the sealed envelope is with you and your interview is up to February 11, 2021. You will be submitting your form to USCIS before the 2 years since the civil surgeon signed and sealed the envelope.

                  This made me a little confused earlier because mine was not submitted with the I-485..
