  • Urgent: i485 filed dated based on Fedex receipt date?

    Hi all,
    Since all EB-2 GC will be retrogressed starting from August, my attorney is trying to file my i140/i485 concurrently until the end of July since priority date is CURRENT now.
    Am i right that if he sends them via Fedex on 31st of July and will get Fedex receipt - forms will be considered as filed in July and will be accepted by USCIS?

    Or USCIS needs to receive them physically by the end of July? In this case he should send it on 30st of July using fedex overnight right so USCIS receives it on 31st?

    Need you help/advise please.

    I think USCIS needs to receive them.
    If they deliver it in August 1st, then USCIS will return your application and you will need to file again in October.

    Day 999 - Card delivered to me - Aug 2021

      Am i right that by "USCIS needs to receive them" you just mean Fedex needs to deliver them?
      Because maybe after delivery USCIS may still take a couple of days to take them into processing.

        Yes, exactly. When Fedex mark your package as 'delivered', in your case must be July 31 at the latest.
