Hi,
I have an approved PERM labor & I-140 with priority date as December, 2007 in EB2 category from Company 'A' for 'FUTURE EMPLOYMENT'. Company 'A' is a small consulting company & waiting for priority date to become current so that my company can file I-485.
Currently I am working for Company 'B' which is a big company and it has filed PERM Labor in December, 2009 in EB2 Category for my current position. PERM application is under processing.
Currently I am holding H1-B VISA sponsored by company 'B' on 5th year.
Now my question.
If I loose my job in future & had to leave this country, How will it impact my green card processing sponsored by Company 'A' for future employment. Can I still move forward with the green card processing through cousellor processing from home country, India when PD becomes current in future.
If so, Can my employer (company 'A') apply for I-485 through counsellor processing from India for me without having valid H1-B Visa and living in India? ple help.
