  • Request For Initial Evidence Was Sent

So after waiting nearly 5 months for any kind of word since my biometrics appointment, instead of receiving notification that my EAD is on it's way, I've instead received a case status update that says a request for initial evidence was sent. I'm extremely frustrated by this as not only has the process already been long and I was expecting the EAD soon, but we paid a lawyer $2,000 to do all of the filing for us and now after all this wait there's an error? Beyond fed up with this process and now it's looking like my cases will be delayed even further while I wait to hear what this further evidence is. Surely the lawyers should have filed everything correctly so a situation like this doesn't happen, otherwise, why did we pay them?! Also looking to find out what this request could be for as I'm anxious for this to be over with. The request was on the I-485, not the I-765, however, I think both will be on hold until they receive this.

When I filed several months ago I too got a RFE, the wanted stuff such a back statements, credit card statements, leases, utility bills, life insurance policies. Receipts and stuff like that. Also note that these evidences should show a time period before the RFE was issued to you or else it’ll seem like you created such evidences only to send in. Another thing, if you don’t have a social security number it’s basically impossible to acquire most of these stuff. I was irritated that they’d ask for things they know we can’t possibly have because we don’t have a social security

EAD applications are typically processed separately than 485 so not much to worry. I got an RFIE too but EAD timeline wasn't delayed.

If your case is a simple one (marriage or employment based, for example), lawyers are costly and provide nothing extra compared to yourself, given that you do your research and file everything carefully. Nothing to do but wait and see what the letter says. Good luck and don't worry much; RFEs aren't too scary if you send them what they want.
