Sister didn’t send I765 form ☹️☹️☹️

My sister sent out the package and today I just found out the employment authorization form wasn’t sent with the I485, she only sent that form and I130 . I’m in the New York area and it shows my application will take about 22 to 30 months, I have 5 kids with my husband and wanted to be able to work to help lift the burden off his shoulder with helping out with bills. I feel so disappointed that depending on my sister she didn’t even send out that form which would have been beneficial while I was waiting. I’ve been in this country since 2002 undocumented and was looking forward to having a employment authorization so I could work.

Sorry about that, it can be really frustrating hoping that you’d get your ead soon but to find out it wasn’t filed at all. The good thing is you can fill the form and send it with your I-485 receipt notice. There is no application fee for I-765 because of your I-485. Good luck.

Yes, like the person above said, you can still easily file the form. The responsibility of filing properly is solely yours, I think.

My husband is the filer but my sister had experience with immigration paperwork and since she was going to be my co sponsor she decided to send out the paper work. We both signed it and she would send out the package with her information, turns out she never sent out the affidavit either so that was requested June 4th I responded back to it July 13th but they didn’t update their system until July 19th. Took some time sending it out of state and receiving the documents back and sending it back to USCIS , she doesn’t live in NYC and I asked her about not sending out the employment authorization she said she didn’t do it cause she thought and still thinks my case would be called soon for the interview. She advised me not to send out the authorization of employment cause it would make the case get held back from scheduling an interview. I showed her the timeframe for NYC I485 and would like to send the employment authorization but I don’t want it to make my case take longer to get the interview. Would the employment authorization pause the case and make the interview scheduling be put on hold.

It won't pause your case. There are people that get the GC and never get the EAD. If filing work authorization paused the GC process, then there would be not cases like those.

Thank you I’m going to be sending it out within the next week. I red somewhere that if I send my I485 receipt With the employment authorization form I won’t have to pay another fee.

Yes, you need to follow the form instructions, send all they ask and instead of payment, send a copy of the I-485 receipt.
You can file form I-131 too if you want to travel abroad before you get GC. Some people don't plan to travel but file anyway (free too), some will not want to travel until GC on hand.
