  • Request of Evidence for Income

    Hello everyone,

We received the request of evidence asking for a joint sponsor,
I am a US citizen, applying for a green card for my husband

    1) I was wondering if an L1a visa holder who happened to return enough tax can be a joint sponsor?
    2) If they can not, we lived most of the time of the tax period out of the USA and therefore my 2018 tax return less than 125%. However, my income in 2019 so far than 125% can I use it?
    3) My husband is a highly experienced software engineer, and he already keeps receiving over **00k annually job offers however since he is still waiting to receive the work permit, he can not accept any, can he use these offers instead of a joint sponsor?

We don't have any big assets,
Only a month left before the time we are requested to respond
if we can not find any solution until the last response date, will we have to start from the beginning?
Is there a way we can wait until my 2019 tax return?
    I would appreciate any information

    1. A joint sponsor has to be a US citizen or Permanent resident.
2.Yes, you can use your current income.
    3. No it has to be current income and not future or past income.

If you can not find a joint sponsor just send them your current pay stubs that show you are making over the 125%. You can include a letter explaining that you were out of the US for the majority of 2018 and thus didnt earn the amount but you are now clearly earning over the 125%. If your income is not borderline you will be fine.
